On Monday, September 9, 2019 after two weeks of trial, a jury returned a unanimous verdict in favor of a Lincoln Derr client.
The jury in this case deliberated for only one hour and forty minutes before returning to the courtroom answering the first issue in the case, “Was the Defendant’s medical negligence a cause of Plaintiff’s death?”, “No.” The case was bifurcated, but had the jury responded “yes” to the first issue, Plaintiff intended to put on in excess of two million dollars worth of damages for lost wages, medical expenses, pain, suffering, and the loss of the decedent to his family.
The case was tried in the traditionally “plaintiff-friendly” jurisdiction of Fayetteville, North Carolina, against two seasoned plaintiff attorneys. When asked about the verdict, Sara Lincoln said, “We had heard that Cumberland County was a difficult venue to get a defense verdict. We used a local attorney to assist us in selecting a jury and we think that helped us get a good group of jurors who were engaged throughout the trial and seemed to fully understand the complexities of this wrongful death case. We were impressed with the juror’s attention throughout the trial and their ability to sift through the evidence to reach what we had always believed was the right result.”
